This presentation will provide an update on DOL developments, including a discussion of the joint employer relationship, independent contractor classification, and wage and hour law. Join us as we look back at the first year of the Biden administration, discussing what the administration’s emphasis on “Worker-Centered Protections” means for employers.

This presentation will provide an overview of the important and interesting case law and employment law developments throughout 2021.

Keynote Address
In this session, David K. Fram, Esq., of the National Employment Law Institute, will discuss the latest developments on practical reasonable accommodation issues including the following: training first-line supervisors on what to listen for as possible triggers to the interactive process, what supervisors and HR personnel should be trained to say and document in response to employee requests, important changes on the definition of “reasonable,” particular accommodation questions, such as exemptions to mandatory COVID vaccination policies, work-at-home because of COVID-19 concerns, whether/how much “leave” — including a repeated leave extension — is required, how this interplays with the FMLA, whether reduced workloads, non-competitive reassignment, an “irritant-free” environment, shift changes, supervisor changes, or reserved parking spaces are required, whether discipline must be rescinded as an accommodation, and the best/worst undue hardship arguments.
